Customer Satisfaction Survey, July 2019 - Random Drawing Promotion

1. ENTRY: Complete the embrace^® Customer Satisfaction Survey sent via email. A entrant must click the link included in the email to enter. Limit one (1) entry per person. Entries will be accepted until 11:59pm PST on August 30th. Five winners will be selected at random.  Any attempt by any participant to obtain more than the stated number of entries by using multiple/different email or addresses, accounts, identities, registrations and logins, or any other methods will void that participant's entries and that participant may be disqualified.  Use of any automated system to participate is prohibited and will result in disqualification.  In the event of a dispute as to any participant, the authorized account holder of the email address associated with the entry will be deemed to be the participant.  The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address.  Each potential winner may be required to show proof of being the authorized account holder.  Sponsor will make final determination of identity of participants in its sole discretion. 

2. ELIGIBILITY: This contest is open only to legal U.S. residents over the age of 18 who are the age of majority in their jurisdiction of residence. Employees of Neodyne Biosciences (along with its contractors, affiliates, and subsidiaries) and their families are not eligible.

4. WINNER NOTIFICATION: Sponsor will notify winners by email and/or by other means consistent with the Promotion within approximately ten (10) days following the drawing.  Sponsor is not responsible for any delay or failure to receive notification for any reason, including inactive account(s), technical difficulties associated therewith, or winner’s failure to adequately monitor any account.  The winners must then respond to Sponsor within fourteen (14) days. Should the winner fail to respond to Sponsor, Sponsor reserves the right to disqualify that winner and select a new one based on timing of submission or in a second-chance random drawing.  Winner may be required to sign an affidavit of eligibility, liability release and a publicity release.  By entering or accepting any prize, each entrant and winner allow Sponsor to use the entrant’s or winner’s name, photograph, likeness, voice, prize information, and biographical information as needed for administering promotion (including announcing winner and providing winner’s name as part of a winner’s list) without further compensation where permitted by law.

5. USE OF GIVEAWAY INFORMATION: All entries become the property of Neodyne Biosciences. Neodyne Biosciences reserves the right to use any and all information related to the giveaway, including submissions provided by the contestants, for editorial, marketing, and any other purpose, unless prohibited by law.

6. DISQUALIFICATION AND TERMINATION.  Entrants found engaging in any of the following activities may be disqualified and ineligible for any prize: (i) tampering with, disrupting, or attempting to disrupt, or any unauthorized use, misuse or abuse of any aspect of a giveaway; (ii) violating any applicable law; (iii) allowing any unauthorized person to use your social media handle or other account related to a giveaway; (iv) attempting to perpetuate fraud through false registration, false impersonation or any other means; (v) failing to provide complete and accurate information; or (vi) for any other breach of these terms.

DISCLAIMER, RELEASE AND LIMIT OF LIABILITY.  SPONSOR MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING ANY PRIZE OR YOUR PARTICIPATION IN A GIVEAWAY.  BY PARTICIPATING IN A GIVEAWAY OR RECEIPT OF ANY PRIZE, EACH ENTRANT AGREES TO RELEASE AND HOLD HARMLESS SPONSOR, FACEBOOK, OTHER SOCIAL MEDIA PLATFORMS AND THEIR SUBSIDIARIES , AFFILIATES, SUPPLIERS, DISTRIBUTORS, PARTNERS, CUSTOMERS, ADVERTISING/PROMOTION AGENCIES, AND PRIZE SUPPLIERS, AND EACH OF THEIR RESPECTIVE PARENT COMPANIES AND EACH SUCH COMPANY’S OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS (COLLECTIVELY, THE “RELEASED PARTIES”) FROM AND AGAINST ANY CLAIM OR CAUSE OF ACTION, INCLUDING, BUT NOT LIMITED TO, PERSONAL INJURY, DEATH, OR DAMAGE TO OR LOSS OF PROPERTY, ARISING OUT OF PARTICIPATION IN THE GIVEAWAY OR RECEIPT OR USE OR MISUSE OF ANY PRIZE.  THE RELEASED PARTIES ARE NOT RESPONSIBLE FOR:  (1) ANY INCORRECT OR INACCURATE INFORMATION, WHETHER CAUSED BY PARTICIPANTS, PRINTING ERRORS OR BY ANY OF THE EQUIPMENT OR PROGRAMMING ASSOCIATED WITH OR UTILIZED IN THE SURVEY; (2) TECHNICAL FAILURES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO MALFUNCTIONS, INTERRUPTIONS, OR DISCONNECTIONS IN PHONE LINES OR NETWORK HARDWARE OR SOFTWARE; (3) UNAUTHORIZED HUMAN INTERVENTION IN ANY PART OF THE GIVEAWAY; (4) TECHNICAL OR HUMAN ERROR WHICH MAY OCCUR IN THE ADMINISTRATION OF THE GIVEAWAY; OR (5) ANY INJURY OR DAMAGE TO PERSONS OR PROPERTY WHICH MAY BE CAUSED, DIRECTLY OR INDIRECTLY, IN WHOLE OR IN PART, FROM PARTICIPANT’S PARTICIPATION IN THE GIVEAWAY OR RECEIPT OR USE OR MISUSE OF ANY PRIZE.  No more than the stated number of prizes will be awarded. In event that production, technical, programming or any other reasons cause more than stated number of prizes as set forth in these terms to be available and/or claimed Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.  Sponsor reserves the right to cancel, amend or suspend a giveaway at any time, with or without prior notice, including if a giveaway encounters any unexpected problems.

You may receive a list of winners by sending a self-addressed envelope to the address above with a request for the names of the winners for a requested date range. By participating in this giveaway, you are acknowledging your understanding that you are providing your information to the Sponsor.
